Representing Clients in the Antimonopoly Committee of Ukraine
One of the ways to protect intellectual property rights includes the administrative remedy under the competition law which proceedings are carried out by the Antimonopoly Committee of Ukraine. The principal normative acts that regulate the competition policy matters include: Act of Ukraine No.3659-XII ‘Antimonopoly Committee of Ukraine’ dated November 26, 1993; Act of Ukraine No.2210-III ‘Protection of Business Competition’ dated January 11, 2001; and Act of Ukraine No.236/96-VR ‘Protection Against Unfair Competition’ dated June 7, 1996.
Subject to Section 1 of the Protection Against Unfair Competition Act of Ukraine, unfair competition means any act of competition which is in conflict with to trading rules and other honest and fair business practices. Subject to Part 2 of the abovementioned Section, such acts, in particular, include the actions defined in Chapter 2 of the Business Goodwill Misuse Act.
